1. Website Use

By accessing this website, you agree to be bound by these Terms of Service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

You agree not to use the ELIZABETH L BUCK website for any unlawful purpose or any purpose prohibited by these terms. This includes, but is not limited to, misuse of the site's content, data scraping, unauthorized access attempts, or interference with the site's functionality. All content on this site, including text, graphics, logos, images, and software, is the property of ELIZABETH L BUCK or its content suppliers and protected by international copyright laws. Any unauthorized use of our intellectual property is strictly prohibited.

2. Product Purchases & Custom Orders

In-Store Purchases: All sales made directly at our Isle of Palms location are final unless otherwise specified by management. We strive to ensure every scoop of our small-batch gelato and seasonal ice cream meets our high standards of quality.

Custom Orders: For custom orders, including specialty flavors and larger quantities, a non-refundable deposit may be required at the time of order confirmation. Cancellations must be made at least 72 hours in advance to potentially receive a partial refund, subject to our discretion. We will communicate all allergen information relevant to your custom order upon request, but cannot guarantee a complete absence of allergens due to shared equipment in our micro creamery. Product availability, especially for seasonal ice cream and farm-to-cone ingredients, is subject to change based on local harvest and supply.

We reserve the right to refuse service or cancel orders at our sole discretion, without limitation, if we suspect fraudulent activity or a violation of these terms.

3. Limitation of Liability

In no event shall ELIZABETH L BUCK, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

While we take every precaution to prevent cross-contamination, ELIZABETH L BUCK operates a micro creamery that handles common allergens including dairy, nuts, soy, and gluten. Consumers with severe allergies should exercise caution. By purchasing our products, you acknowledge and accept the inherent risk of allergen exposure and agree to hold ELIZABETH L BUCK harmless from any adverse reactions.
